Stack N Go Totes Terms of Service

By purchasing, using and/or accessing  Stack N Go Totes's services you confirm that you have read, understood, and agreed to the following Terms of Service in their entirety.

DEFINITIONS

The following terminology applies to these Terms of Service and all agreements between the parties.

“Renter,” “You,” and “Your” refers to the individual purchasing, using, and/or accessing Stack N Go Totes services and thereby agreeing to these Terms of Service in their entirety.

“Stack N Go Totes,” “We,” “Us,” and “Our” refers to Mellisa Gross and/or Stack N Go Totes and/or its employees, representatives, contractors, agents, or any other individuals or entities for whom Stack N Go Totes is legally responsible.

“Party” or “Parties” refers to both the Renter and Stack N Go Totes collectively, or either the Renter or Stack N Go Totes individually, as the context requires.

“Services” refers to any and all services, programs, products, and/or offerings provided by Stack N Go Totes, including but not limited to the rental, delivery, and pickup of Equipment.

“Equipment” refers to any and all items rented to the Renter by Stack N Go Totes, including but not limited to moving totes, dollies, and any associated accessories.

“Rental Period” means the duration of the Renter’s equipment rental as confirmed on the Renter’s invoice issued by Stack N Go Totes.

“Website” refers to stackngototes.ca and any successor, affiliated, or associated domains operated by Stack N Go Totes.

These Terms of Service apply to all users of Stack N Go Totes services and/or Equipment without exception. Any use of the above terminology or other words in the singular, plural, capitalized, or gendered form shall be taken as interchangeable and referring to the same.

Overview of Services

Upon purchase of Stack N Go Totes services, Stack N Go Totes agrees to rent the Equipment to the Renter for the duration of the confirmed Rental Period.

At the commencement of the Rental Period, Stack N Go Totes will deliver the Equipment to the Renter’s current address. At the conclusion of the Rental Period, Stack N Go Totes will collect the Equipment from the Renter’s new address as confirmed at the time of booking.

Please note that Stack N Go Totes does not provide packing, loading, unloading, or moving assistance of any kind. All packing, loading, unloading, and moving activities remain the sole responsibility of the Renter.

All Equipment rented to the Renter remains the sole and exclusive property of Stack N Go Totes at all times during and after the Rental Period.

Rental Period

The standard minimum Rental Period offered by Stack N Go Totes is fourteen (14) calendar days. All rentals are subject to this minimum Rental Period regardless of the Renter’s intended or actual duration of use.

In the event that the Renter returns the Equipment prior to the conclusion of the fourteen (14) day minimum Rental Period, the Renter acknowledges and agrees that no refund, credit, or reduction in rental fees shall be issued for any unused portion of the Rental Period. The full fourteen (14) day rental fee remains due and payable in its entirety regardless of early return.

Should the Renter require the Equipment beyond the standard fourteen (14) day minimum Rental Period, Stack N Go Totes may accommodate longer term rentals at its sole discretion and subject to equipment availability. Stack N Go Totes makes no guarantee that extended Rental Periods will be available. Any extension must be requested and confirmed in writing prior to the conclusion of the original Rental Period. Additional rental fees will apply for any approved extension.

Delivery Area

Stack N Go Totes provides services exclusively to Renters located within our designated delivery area for both delivery and pickup of Equipment. To view the regions we currently service please click here. Stack N Go Totes may also, at its sole discretion, provide services to Renters located within one hundred (100) kilometres of Strathmore, Alberta, Canada.

 

Reserving Equipment

To reserve Equipment, the Renter must visit the desired Package page on the Stack N Go Totes website and select the preferred Rental Period, subject to the minimum Rental Period outlined in these Terms of Service. The Renter can access the Package page directly by clicking here.

The minimum Equipment order accepted by Stack N Go Totes is fifteen (15) Totes per rental. Orders of fewer than fifteen (15) Totes will not be accepted.

The Renter may also select optional equipment add-ons after adding the desired number of Totes to the Renter’s cart, subject to availability at the time of booking.

Once the Renter has submitted an order through the Stack N Go Totes website, Stack N Go Totes will review the order and confirm equipment availability. If sufficient Equipment is available, Stack N Go Totes will send the Renter a confirmation email outlining the details of the rental and any further instructions regarding next steps.

For greater certainty, the submission of an order through the Stack N Go Totes website does not constitute a guarantee of equipment availability. Stack N Go Totes reserves the right to decline any order in the event that sufficient Equipment is unavailable at the time of booking.

Laundry Bags

The Renter may add Laundry Bags to their order as an optional equipment add-on at the time of booking, subject to availability. Laundry Bags are rented at a rate of four dollars ($4.00) per bag per Rental Period, as outlined on the Packages page of the Stack N Go Totes website. Laundry Bags rented under this Agreement are subject to the same terms, conditions, and Renter responsibilities applicable to all other Equipment as set out in this Agreement, including but not limited to the Condition of Equipment, Damage Deposit, and Replacement Fees sections.



 

Payment

Payment for all Stack N Go Totes services is due in full at the time of purchase. Upon checkout on the Stack N Go Totes website, the Renter must select one of the following accepted payment methods: bank transfer via Interac E-Transfer or credit card payment via Stripe.

Payment by Interac E-Transfer

If the Renter selects Interac E-Transfer as the chosen method of payment, the Renter’s order will be placed in a hold status immediately following checkout. The Renter will receive an email confirming that the order is on hold and awaiting payment. Stack N Go Totes will reserve the Renter’s order for twenty-four (24) hours from the time of checkout while awaiting receipt of the E-Transfer payment.

If full payment is not received within twenty-four (24) hours of checkout, Stack N Go Totes reserves the right to cancel the Renter’s order without further notice. If full payment is received within twenty-four (24) hours of checkout, Stack N Go Totes will send the Renter a confirmation email, subject to equipment availability.

Payment by Credit Card

If the Renter selects credit card as the chosen method of payment, payment will be processed securely through Stripe, a third party credit card payment processor. Stack N Go Totes does not have access to the Renter’s full credit card number. Only the last four (4) digits of the Renter’s credit card number are accessible to Stack N Go Totes for reference purposes.

Stripe currently accepts the following credit cards: MasterCard, Visa, American Express, and Discover.

Upon checkout, a pre-authorization will be initiated for the full amount owing for Stack N Go Totes services. For greater certainty, this pre-authorized amount will not be fully processed or charged until Stack N Go Totes has confirmed equipment availability and approved the Renter’s order.

General Payment Terms

By agreeing to these Terms of Service, the Renter agrees to pay all fees and charges specified on the Stack N Go Totes website and within these Terms of Service for all services purchased.

All fees are exclusive of applicable federal and provincial taxes unless otherwise stated. The Renter is solely responsible for the payment of any and all applicable taxes imposed on the Renter’s use of Stack N Go Totes services.

Stack N Go Totes reserves the right to charge any fees or payments authorized by the Renter to the account and payment method designated by the Renter at the time of checkout. In the event that payment is not successfully received from the Renter’s designated payment method, the Renter agrees to pay all outstanding amounts in full upon demand by Stack N Go Totes.

Stack N Go Totes reserves the right to modify the fees for its services or to introduce new fees at any time and at its sole discretion. All fees charged by Stack N Go Totes are final and non-refundable except as explicitly stated within these Terms of Service.

Changes to Order

Should the Renter require any changes to an existing order, including changes to the Rental Period or the amount of Equipment ordered, the Renter must call, text, or email Stack N Go Totes immediately.

Stack N Go Totes will make every reasonable effort to accommodate the requested change, subject to equipment availability at the time of the request.

Changes to Rental Period Dates

If the Renter requires a change to the dates of the Rental Period but the total length of the Rental Period remains the same, Stack N Go Totes will accommodate the date change at no additional charge, subject to equipment availability.

If the Renter requires an extension to the total length of the Rental Period, Stack N Go Totes will accommodate the extension upon receipt of full payment of Stack N Go Totes daily equipment rental rate for the additional period requested, subject to equipment availability.

If Stack N Go Totes is unable to accommodate the Renter’s requested date change and the Renter wishes to cancel the order as a result, the cancellation will be processed in accordance with the Stack N Go Totes Cancellation Policy.

Changes to Equipment Order

If the Renter requires additional Equipment or a change to the type of Equipment ordered, the Renter may submit a request for additional Equipment by clicking here.

If the original order has already been delivered to the Renter at the time of the request, the additional Equipment will be subject to a separate delivery fee regardless of whether the Renter qualified for free delivery on the original order. Upon payment for the additional Equipment and applicable delivery fees, the Renter will receive an email containing a link to schedule the additional delivery.

If the original order has not yet been delivered to the Renter at the time of the request, no additional delivery fee will apply. The Renter will be required to pay only the difference in Equipment costs between the original order and the updated order.

All changes to Equipment orders are subject to availability at the time of the request.

Cancellation Policy

The Renter may request the cancellation of an order at any time prior to the scheduled delivery of the Equipment by contacting Stack N Go Totes directly via call, text, or email. All cancellation requests must be received and acknowledged in writing by Stack N Go Totes to be considered valid.

The following cancellation terms apply based on the timing of the cancellation request:

Cancellation More Than Forty-Eight (48) Hours Prior to Scheduled Delivery

If the Renter submits a valid cancellation request more than forty-eight (48) hours prior to the Renter’s scheduled delivery time, Stack N Go Totes may, at its sole discretion, issue a refund to the Renter for the full amount paid, less a five percent (5%) administrative fee. The five percent (5%) administrative fee is non-refundable under all circumstances.

Cancellation Within Forty-Eight (48) Hours of Scheduled Delivery

If the Renter submits a cancellation request within forty-eight (48) hours of the Renter’s scheduled delivery time, no monetary refund will be issued. In lieu of a monetary refund, the Renter will receive a Stack N Go Totes store credit equal to the full amount paid, less a five percent (5%) administrative fee. Store credits may be applied toward future Equipment rentals with Stack N Go Totes and are subject to the terms and conditions applicable to store credits as determined by Stack N Go Totes from time to time.

Cancellation After Delivery of Equipment

If the Renter requests a cancellation after the Equipment has been delivered to the Renter’s address, no monetary refund and no store credit of any kind will be issued to the Renter. The full rental fee remains due and payable in its entirety.

General Cancellation Terms

Stack N Go Totes reserves the right to cancel any order at any time at its sole discretion. In the event that Stack N Go Totes cancels an order, the Renter will receive a full refund of all amounts paid, including any applicable administrative fees.

All cancellation requests are subject to review and approval by Stack N Go Totes. Stack N Go Totes reserves the right to decline any cancellation request that does not meet the requirements set out in this Cancellation Policy.

Delivery

Delivery Charges

If the Renter’s delivery address is located within the Stack N Go Totes designated free delivery zone, no delivery charge will apply. If the Renter’s delivery address is located outside of the designated free delivery zone, delivery charges will apply as outlined on the respective Packages page of the Stack N Go Totes website.

Damage Deposit and Delivery Scheduling

“Within seven (7) calendar days of the Renter’s payment for their order, the Renter must complete both of the following requirements.

First, the Renter must pay the required refundable two hundred dollar ($200.00) damage deposit in full. The damage deposit must be paid in full before any Equipment will be delivered to the Renter.

Second, the Renter must select a confirmed delivery date and time from the available options provided by Stack N Go Totes at the time of scheduling.

Failure to complete both of the above requirements within the specified seven (7) calendar day period may result in the cancellation of the Renter’s booking at the sole discretion of Stack N Go Totes.

Stack N Go Totes will make every reasonable effort to accommodate the Renter’s preferred delivery date and time. However, there may be occasions where Stack N Go Totes is fully booked or where available delivery windows do not coincide with the Renter’s preferred schedule. In such cases, Stack N Go Totes may, at its sole discretion and subject to equipment availability, offer the Renter an alternative delivery date or time. Where an earlier delivery date is offered and accepted by the Renter, Stack N Go Totes may, at its sole discretion, provide one (1) additional rental day at no extra charge as a courtesy to the Renter.

Delivery Reminder Notifications

Stack N Go Totes will send automated reminder notifications to the Renter by both email and text message approximately twenty-four (24) hours prior to the Renter’s scheduled one (1) hour delivery window. These notifications will be sent to the email address and phone number provided by the Renter at the time of booking.

It is the sole responsibility of the Renter to ensure that all contact information provided at the time of booking is accurate and current. Stack N Go Totes shall not be responsible for any missed notifications resulting from inaccurate or outdated contact information provided by the Renter.

It is further the sole responsibility of the Renter to ensure that an authorized adult is present and available at the confirmed delivery address during the entirety of the scheduled one (1) hour delivery window to accept delivery of the Equipment.

Renter Absence at Time of Delivery

In the event that no authorized adult is present at the confirmed delivery address during the scheduled one (1) hour delivery window, Stack N Go Totes reserves the right to treat the delivery as a failed attempt. In such cases a redelivery fee may apply and the Renter’s Rental Period will be deemed to have commenced at the originally scheduled delivery date and time regardless of whether delivery was successfully completed. Stack N Go Totes shall not be responsible for any loss, inconvenience, or additional costs incurred by the Renter as a result of a failed delivery attempt due to Renter absence.

Stack N Go Totes Right to Modify Delivery Schedule

Stack N Go Totes expressly reserves the right to modify, reschedule, or cancel a confirmed delivery date and/or delivery time in the event of weather conditions, road closures, traffic delays, vehicle breakdowns, staff illness, equipment damage, equipment unavailability, emergencies, acts of God, or any other unforeseen circumstance beyond the reasonable control of Stack N Go Totes. In such cases Stack N Go Totes will make all reasonable efforts to notify the Renter by email and text message as soon as practically possible and will work with the Renter to establish a mutually agreeable alternative delivery date and time.

Limitation of Liability for Delivery Changes

Under no circumstances shall Stack N Go Totes be liable for any direct, indirect, incidental, special, consequential, or punitive damages of any nature arising from or related to any modification, rescheduling, delay, or cancellation of a scheduled delivery date or delivery time. This limitation of liability applies regardless of the cause of the change and regardless of whether Stack N Go Totes was advised of the possibility of such damages.

Pick Up

Pickup Charges

If the Renter’s pickup address is located within the Stack N Go Totes designated free pickup zone, no pickup charge will apply. If the Renter’s pickup address is located outside of the designated free pickup zone, pickup charges will apply as outlined on the respective Packages page of the Stack N Go Totes website.

Scheduling Pickup

After booking their rental, the Renter may select their preferred pickup date and time. If the Renter is unable to confirm their availability at the time of booking, the Renter may choose to schedule their pickup at a later date. All pickup requests are subject to availability and are not confirmed until formally approved by Stack N Go Totes. Stack N Go Totes will notify the Renter by both email and text message upon confirmation of the scheduled pickup date and time.

Pickup Availability

Stack N Go Totes will make every reasonable effort to accommodate the Renter’s preferred pickup date and time. However there may be occasions where Stack N Go Totes is fully booked for pickups or where available pickup windows do not coincide with the Renter’s preferred schedule. In such cases Stack N Go Totes may at its sole discretion and subject to equipment availability offer the Renter one (1) complimentary additional day and perform the pickup on the day immediately following the scheduled end of the Rental Period.

Pickup Reminder Notifications

Stack N Go Totes will send automated reminder notifications to the Renter by both email and text message approximately twenty-four (24) hours prior to the Renter’s scheduled one (1) hour pickup window. These notifications will be sent to the email address and phone number provided by the Renter at the time of booking.

It is the sole responsibility of the Renter to ensure that all contact information provided at the time of booking is accurate and current. Stack N Go Totes shall not be responsible for any missed notifications resulting from inaccurate or outdated contact information provided by the Renter.

It is the sole responsibility of the Renter to ensure that all rented Equipment is accessible, consolidated, and ready for collection at the confirmed pickup address during the entirety of the scheduled one (1) hour pickup window.

Renter Responsibility at Time of Pickup

In the event that the Equipment is not accessible or ready for collection during the scheduled one (1) hour pickup window Stack N Go Totes reserves the right to treat the pickup as a failed attempt. In such cases a re-pickup fee may apply. Stack N Go Totes shall not be responsible for any loss, inconvenience, or additional costs incurred by the Renter as a result of a failed pickup attempt due to the Renter’s failure to make the Equipment accessible and ready for collection.

Stack N Go Totes Right to Modify Pickup Schedule

Stack N Go Totes expressly reserves the right to modify, reschedule, or cancel a confirmed pickup date and/or pickup time in the event of weather conditions, road closures, traffic delays, vehicle breakdowns, staff illness, equipment damage, emergencies, acts of God, or any other unforeseen circumstance beyond the reasonable control of Stack N Go Totes. In such cases Stack N Go Totes will make all reasonable efforts to notify the Renter by both email and text message as soon as practically possible and will work with the Renter to establish a mutually agreeable alternative pickup date and time.

Limitation of Liability for Pickup Changes

Under no circumstances shall Stack N Go Totes be liable for any direct, indirect, incidental, special, consequential, or punitive damages of any nature arising from or related to any modification, rescheduling, delay, or cancellation of a scheduled pickup date or pickup time. This limitation of liability applies regardless of the cause of the change and regardless of whether Stack N Go Totes was advised of the possibility of such damages.

Self Pick up

Damage Deposit and Self Pickup Scheduling

“Within seven (7) calendar days of the Renter’s payment for their order, the Renter must complete both of the following requirements.

First, the Renter must pay the required refundable two hundred dollar ($200.00) damage deposit in full. The damage deposit must be paid in full before any Equipment will be released to the Renter for self pickup.

Second, the Renter must select a confirmed self pickup date and time from the available options provided by Stack N Go Totes at the time of scheduling. Failure to complete both of the above requirements within the specified seven (7) calendar day period may result in the cancellation of the Renter’s booking at the sole discretion of Stack N Go Totes.”

Self Pickup Scheduling and Availability

After booking their rental, the Renter may select their preferred self pickup date and time. If the Renter is unable to confirm their availability at the time of booking, the Renter may choose to schedule their self pickup at a later date. All self pickup requests are subject to availability and are not confirmed until formally approved by Stack N Go Totes. Stack N Go Totes will notify the Renter by both email and text message upon confirmation of the scheduled self pickup date and time.

Stack N Go Totes will make every reasonable effort to accommodate the Renter’s preferred self pickup date and time. However there may be occasions where Stack N Go Totes is fully booked for self pickup time slots or where available time slots do not coincide with the Renter’s preferred schedule. In such cases Stack N Go Totes may at its sole discretion and subject to equipment availability offer the Renter one (1) complimentary additional day and schedule the self pickup for the day immediately prior to the commencement of the Rental Period.

Self Pickup Reminder Notifications

Stack N Go Totes will send automated reminder notifications to the Renter by both email and text message approximately twenty-four (24) hours prior to the Renter’s scheduled one (1) hour self pickup window. These notifications will be sent to the email address and phone number provided by the Renter at the time of booking.

It is the sole responsibility of the Renter to ensure that all contact information provided at the time of booking is accurate and current. Stack N Go Totes shall not be responsible for any missed notifications resulting from inaccurate or outdated contact information provided by the Renter.

It is the sole responsibility of the Renter to ensure that an authorized adult is present and available to collect the Equipment during the entirety of the scheduled one (1) hour self pickup window.

Renter Absence at Time of Self Pickup

In the event that the Renter or an authorized adult fails to collect the Equipment during the scheduled one (1) hour self pickup window Stack N Go Totes reserves the right to treat the self pickup as a failed attempt. In such cases a rescheduling fee may apply and the Renter’s Rental Period will be deemed to have commenced at the originally scheduled self pickup date and time regardless of whether the Equipment was successfully collected. Stack N Go Totes shall not be responsible for any loss, inconvenience, or additional costs incurred by the Renter as a result of a failed self pickup attempt due to Renter absence.

Stack N Go Totes Right to Modify Self Pickup Schedule

Stack N Go Totes expressly reserves the right to modify, reschedule, or cancel a confirmed self pickup date and/or time in the event of weather conditions, road closures, traffic delays, vehicle breakdowns, staff illness, equipment damage, emergencies, acts of God, or any other unforeseen circumstance beyond the reasonable control of Stack N Go Totes. In such cases Stack N Go Totes will make all reasonable efforts to notify the Renter by both email and text message as soon as practically possible and will work with the Renter to establish a mutually agreeable alternative self pickup date and time.

Limitation of Liability for Self Pickup Changes

Under no circumstances shall Stack N Go Totes be liable for any direct, indirect, incidental, special, consequential, or punitive damages of any nature arising from or related to any modification, rescheduling, delay, or cancellation of a scheduled self pickup date or time. This limitation of liability applies regardless of the cause of the change and regardless of whether Stack N Go Totes was advised of the possibility of such damages.

Self Drop off

Self Drop Off Scheduling

After booking their rental, the Renter may select their preferred Self Drop Off date and time. If the Renter is unable to confirm their availability at the time of booking, the Renter may choose to schedule their Self Drop Off at a later date. All Self Drop Off requests are subject to availability and are not confirmed until formally approved by Stack N Go Totes. Stack N Go Totes will notify the Renter by both email and text message upon confirmation of the scheduled Self Drop Off date and time.

Self Drop Off Availability

Stack N Go Totes will make every reasonable effort to accommodate the Renter’s preferred Self Drop Off date and time. However there may be occasions where Stack N Go Totes has limited Self Drop Off availability or where available time slots do not coincide with the Renter’s preferred schedule. In such cases Stack N Go Totes may at its sole discretion and subject to equipment availability offer the Renter one (1) complimentary additional day and permit Self Drop Off on the day immediately following the scheduled end of the Rental Period.

Self Drop Off Reminder Notifications

Stack N Go Totes will send automated reminder notifications to the Renter by both email and text message approximately twenty-four (24) hours prior to the Renter’s scheduled one (1) hour Self Drop Off window. These notifications will be sent to the email address and phone number provided by the Renter at the time of booking.

It is the sole responsibility of the Renter to ensure that all contact information provided at the time of booking is accurate and current. Stack N Go Totes shall not be responsible for any missed notifications resulting from inaccurate or outdated contact information provided by the Renter.

Renter Responsibilities at Time of Self Drop Off

It is the sole responsibility of the Renter to arrive within the scheduled one (1) hour Self Drop Off window and return all rented Equipment to Stack N Go Totes in accordance with this Agreement. All Equipment must be returned clean, undamaged, and in the same condition as it was received by the Renter at the commencement of the Rental Period.

In the event that the Renter fails to arrive within the scheduled one (1) hour Self Drop Off window Stack N Go Totes reserves the right to treat the Self Drop Off as a failed attempt. In such cases a rescheduling fee may apply. Stack N Go Totes shall not be responsible for any loss, inconvenience, or additional costs incurred by the Renter as a result of a failed Self Drop Off attempt due to Renter absence.

In the event that the Renter arrives outside of the scheduled one (1) hour Self Drop Off window without prior notice and approval from Stack N Go Totes, Stack N Go Totes reserves the right to refuse the drop off and require the Renter to reschedule. A rescheduling fee may apply in such cases.

Stack N Go Totes Right to Modify Self Drop Off Schedule

Stack N Go Totes expressly reserves the right to modify, reschedule, or cancel a confirmed Self Drop Off date and/or time in the event of weather conditions, road closures, traffic delays, staff illness, scheduling conflicts, emergencies, acts of God, or any other unforeseen circumstance beyond the reasonable control of Stack N Go Totes. In such cases Stack N Go Totes will make all reasonable efforts to notify the Renter by both email and text message as soon as practically possible and will work with the Renter to establish a mutually agreeable alternative Self Drop Off date and time.

Limitation of Liability for Self Drop Off Changes

Under no circumstances shall Stack N Go Totes be liable for any direct, indirect, incidental, special, consequential, or punitive damages of any nature arising from or related to any modification, rescheduling, delay, or cancellation of a scheduled Self Drop Off date or time. This limitation of liability applies regardless of the cause of the change and regardless of whether Stack N Go Totes was advised of the possibility of such damages.

Refused Entry

REFUSED ENTRY AND FAILURE TO RETURN EQUIPMENT

The timely return of all Equipment is a critical condition of this Agreement. Stack N Go Totes relies on the return of Equipment at the conclusion of each Rental Period in order to serve other Renters. Failure to return Equipment on time or refusal to allow Stack N Go Totes to collect Equipment causes direct financial harm to Stack N Go Totes and will result in strict penalties as outlined in this section.

Circumstances Constituting Refused Entry or Failure to Return

The following circumstances shall each individually constitute a breach of this Agreement and will trigger the penalties outlined below:

The Renter fails to select a confirmed pickup date and time prior to the conclusion of the Rental Period. The Renter fails to select a confirmed Self Drop Off date and time prior to the conclusion of the Rental Period. The Renter refuses to allow Stack N Go Totes to collect the Equipment at the confirmed pickup address during the scheduled pickup window. The Renter fails to answer the door or make the Equipment accessible at the confirmed pickup address during the scheduled one (1) hour pickup window. The Renter fails to return the Equipment to Stack N Go Totes during the scheduled Self Drop Off window without prior notice and approval from Stack N Go Totes.

Penalty for Overdue Equipment

In the event that any of the above circumstances occur, Stack N Go Totes shall be entitled to charge the Renter twice the standard daily rental rate for each and every calendar day that the Equipment remains in the possession of the Renter beyond the conclusion of the confirmed Rental Period. These overdue charges will begin accruing immediately upon the expiration of the Rental Period and will continue to accrue on a daily basis until all Equipment has been returned to Stack N Go Totes in full and in accordance with this Agreement.

Additional Pickup Attempt Fees

In addition to overdue Equipment charges, Stack N Go Totes shall be entitled to charge the Renter additional pickup attempt fees for each kilometer travelled by Stack N Go Totes in any attempt to collect overdue Equipment from the Renter. These fees will be charged at the rate specified on the Stack N Go Totes website at the time of the pickup attempt.

Replacement Fees for Unreturned Equipment

In the event that Stack N Go Totes is unable to facilitate the collection of the Equipment within fourteen (14) calendar days from the conclusion of the Rental Period, the Renter will be deemed to have failed to return the Equipment entirely. In such cases the Renter will be charged the full replacement cost for all unreturned Equipment as specified below. The charging of replacement fees does not release the Renter from any other obligations or penalties outstanding under this Agreement.

Stack N Go Totes Right to Pursue Recovery

In the event that the Renter refuses to return the Equipment or cannot be contacted following the conclusion of the Rental Period, Stack N Go Totes expressly reserves the right to pursue all available legal remedies to recover the Equipment and all outstanding fees and charges owed by the Renter. This includes but is not limited to civil action, debt collection, and reporting of the matter to relevant authorities. All costs incurred by Stack N Go Totes in pursuing recovery of Equipment or outstanding fees shall be the sole responsibility of the Renter.

Condition of Equipment

Stack N Go Totes warrants that all Equipment will be in satisfactory operating condition at the time of delivery or self pickup, subject to reasonable wear and tear. Stack N Go Totes takes pride in delivering clean, well maintained, and fully functional Equipment to every Renter on every rental.

Renter Inspection Responsibility

Immediately upon delivery or self pickup of the Equipment the Renter is strongly encouraged to carefully inspect all Equipment to determine whether any damage occurred during delivery or was present at the time of collection. It is the sole responsibility of the Renter to conduct this inspection promptly and thoroughly upon receipt of the Equipment.

Reporting Damaged Equipment

If the Renter identifies any damage to the Equipment at the time of delivery or self pickup the Renter must notify Stack N Go Totes within twenty four (24) hours of receiving the Equipment by call, text, or email. Stack N Go Totes will review the reported damage and may at its sole discretion and subject to equipment availability replace the damaged Equipment at no additional charge to the Renter including no additional delivery charges.

Deemed Acceptance of Equipment Condition

If the Renter fails to notify Stack N Go Totes of any damage within twenty four (24) hours of delivery or self pickup the Renter shall be deemed to have accepted the Equipment as being in satisfactory operating condition at the time of receipt. No damage claims will be accepted by Stack N Go Totes after the twenty four (24) hour inspection period has elapsed.

Renter Responsibility for Equipment Condition During Rental Period

From the moment the Equipment is delivered to or collected by the Renter the Renter assumes full responsibility for the care, safety, and condition of all Equipment for the duration of the Rental Period. The Renter is responsible for ensuring that all Equipment is kept in a safe and secure location and is protected from damage, theft, loss, and misuse during the Rental Period.

All Equipment must be returned to Stack N Go Totes in the same clean and undamaged condition as it was received by the Renter at the commencement of the Rental Period, subject to reasonable wear and tear. Any damage beyond reasonable wear and tear identified at the time of return will be subject to the damage and replacement fees outlined in this Agreement.

This responsibility extends equally to any Laundry Bags rented under this Agreement, which must be returned clean and free of any liquid, food, or other substances likely to cause staining, odor, or damage to other Equipment.

Damage Deposit

The Renter is required to pay a refundable damage deposit of two hundred dollars ($200.00) within seven (7) calendar days of payment for their order, and in all cases before any Equipment is delivered or released to the Renter. The Renter may pay the damage deposit at the time of checkout or through a payment link provided by Stack N Go Totes. This deposit is collected to encourage the Renter to take proper care of all rented Equipment throughout the duration of the Rental Period.

The damage deposit must be paid by credit card only. Payment of the damage deposit by Interac E-Transfer is not accepted. This requirement exists so that any refundable portion of the damage deposit can be returned directly and promptly to the same credit card from which it was paid. For the Renter’s security, Stack N Go Totes processes all deposit payments through Stripe and does not have access to the Renter’s full credit card number at any time. Only the last four (4) digits of the Renter’s card are visible to Stack N Go Totes for reference purposes.

Damage Deposit is Not a Limitation of Liability

The damage deposit is not a limitation of the Renter’s liability under this Agreement. The Renter remains fully and solely responsible for any and all damaged, lost, missing, stolen, unreturned, excessively dirty, or otherwise compromised Equipment, together with any and all replacement costs, cleaning charges, late fees, collection costs, or any other amounts owing under this Agreement regardless of whether such amounts exceed the value of the damage deposit.

Application of Damage Deposit

Stack N Go Totes reserves the right to apply all or any portion of the damage deposit toward any amounts owing by the Renter under this Agreement. In the event that the total amount owing by the Renter exceeds the value of the damage deposit, the Renter shall remain solely responsible for the full outstanding balance.

Payment by Credit Card

If the Renter’s original order was paid by credit card, the Renter hereby expressly authorizes Stack N Go Totes to charge the credit card used for the original reservation and/or damage deposit for any and all amounts owing beyond the value of the damage deposit without further notice to the Renter.

Payment by Interac E-Transfer or No Valid Credit Card on File

If the Renter’s original order was paid by Interac E-Transfer, or if no valid credit card is available for processing at the time charges are incurred, Stack N Go Totes shall issue a formal invoice to the Renter for the full outstanding balance. All invoices issued under this Agreement shall be due and payable in full within seven (7) calendar days of the invoice date.

Failure to Pay Outstanding Invoice

In the event that the Renter fails to pay any outstanding invoice within the required seven (7) calendar day period, Stack N Go Totes reserves the right to pursue any and all remedies available under applicable Alberta and Canadian law. This includes but is not limited to referring the account to a third party collection agency, commencing civil legal proceedings to recover the outstanding balance, and seeking recovery of all associated collection costs, court costs, legal fees, and any other expenses permitted by law.

Full Recovery of Damages

For greater certainty Stack N Go Totes shall not be limited to the value of the damage deposit in recovering amounts owed by the Renter. Stack N Go Totes expressly reserves the right to recover the full amount of any and all damages, losses, fees, charges, and costs owed by the Renter under this Agreement by any means available under applicable Alberta and Canadian law.

Cleaning Fees

Stack N Go Totes confirms that all Equipment will be thoroughly inspected, cleaned, and sanitized using our eco-friendly cleaning solution prior to every delivery or self pickup. Every Renter receives Equipment that meets the Stack N Go Totes cleanliness standard without exception.

Renter Cleaning Responsibilities

Upon the conclusion of the Rental Period the Renter is not required to clean the Equipment prior to returning it to Stack N Go Totes. Stack N Go Totes handles all standard post-rental cleaning and sanitization as part of its normal operations.

Excessive Cleaning Fee

However if Stack N Go Totes determines in its sole and absolute discretion that any Equipment returned by the Renter contains excessive debris, dirt, pet fur, or any other substance requiring cleaning beyond the standard post-rental cleaning process, Stack N Go Totes shall be entitled to charge the Renter a cleaning fee of two dollars ($2.00) per piece of Equipment requiring additional cleaning. This cleaning fee shall be retained from the Renter’s damage deposit or charged to the Renter’s payment method on file in accordance with the payment terms outlined in this Agreement.

Laundry Bags

Laundry Bags carry a higher risk of requiring additional cleaning due to their use in transporting linens, bedding, and clothing, which may be damp, soiled, or carrying odors at the time of packing. If Stack N Go Totes determines in its sole and absolute discretion that a returned Laundry Bag requires cleaning beyond standard post-rental sanitization due to moisture, staining, odor, or soiling, the two dollar ($2.00) per piece Excessive Cleaning Fee outlined above shall apply equally to Laundry Bags as it does to all other Equipment under this Agreement.

Stack N Go Totes Cleaning Standard

The determination of whether Equipment requires excessive cleaning shall be made exclusively by Stack N Go Totes in its sole and absolute discretion. The Renter acknowledges and agrees that Stack N Go Totes’s determination in this regard shall be final and binding.

Replacement Fees

REPLACEMENT FEES

Proper care and safekeeping of all Equipment during the Rental Period is the sole responsibility of the Renter. The Renter assumes full responsibility for all Equipment from the moment of delivery or self pickup until the Equipment is returned to and accepted by Stack N Go Totes at the conclusion of the Rental Period.

Applicable Replacement Fees

The following replacement fees shall apply in the event that any Equipment is damaged, lost, stolen, or not returned to Stack N Go Totes for any reason whatsoever, regardless of whether such damage, loss, or theft is due to the fault of the Renter:

  • One hundred and twenty five dollars ($125.00) per Tote.
  • Twenty dollars ($20.00) per Laundry Bag
  • One hundred and fifty dollars ($150.00) per dolly

These replacement fees represent the minimum amount Stack N Go Totes shall be entitled to recover per piece of Equipment and do not limit Stack N Go Totes from recovering any additional costs, losses, or expenses incurred as a result of damaged, lost, stolen, or unreturned Equipment.

Recovery of Replacement Fees

Stack N Go Totes shall be entitled to retain replacement fees from the Renter’s damage deposit where applicable. In the event that the damage deposit is insufficient to cover the full amount of replacement fees owing, Stack N Go Totes shall be entitled to charge the full outstanding balance of replacement fees to the credit card on file or issue a formal invoice to the Renter in accordance with the payment terms outlined in this Agreement.

Equipment Storage Requirements

All Equipment must be stored indoors at all times during the Rental Period. The Renter is solely responsible for ensuring that all Equipment is kept in a safe, secure, and protected indoor location throughout the duration of the Rental Period. Stack N Go Totes shall not be responsible for any damage, loss, or theft of Equipment that occurs as a result of the Renter’s failure to store the Equipment indoors. Full replacement fees will apply in the event of theft or damage resulting from improper storage of Equipment by the Renter.

Labels and Alterations

Stack N Go Totes provides one (1) complimentary label per Tote rented for the Renter’s personal use during the Rental Period. Labels provided by Stack N Go Totes may only be placed on the designated rough spot located on the side of the Tote below the handles.

Labels must not under any circumstances be placed over the Stack N Go Totes logo. Placing any label or tape over the logo will cause damage to the logo finish and will result in damage charges being applied to the Renter’s account.

The Renter shall not place any tape, stickers, labels, or markings of any kind on any Equipment other than the labels provided by Stack N Go Totes in the designated location described above.

No alteration, modification, or customization of any Equipment shall be made by the Renter without the prior written consent of Stack N Go Totes. Any unauthorized alteration or modification of Equipment will result in replacement fees being charged to the Renter in accordance with this Agreement.

DISCLAIMER NOTICE - Exclusions and Limitations

By purchasing, using, and/or accessing Stack N Go Totes services and/or Equipment, the Renter acknowledges and agrees to all of the following without exception.

Assumption of Risk

The Renter acknowledges that there is an inherent and serious risk of personal injury, including death, associated with the use of moving Equipment including Totes, dollies, and any associated accessories. The Renter accepts and assumes full and sole responsibility for all risks associated with the use of Stack N Go Totes Equipment by the Renter and any other individual who uses the Equipment during the Rental Period.

Physical, Emotional, and Mental Capacity

Prior to using Stack N Go Totes Equipment the Renter confirms that the Renter and all individuals who will be using the Equipment during the Rental Period are physically, emotionally, and mentally capable of safely operating and using the Equipment. It is the sole responsibility of the Renter to make this determination prior to using the Equipment. Stack N Go Totes makes no assessment of the physical, emotional, or mental capacity of the Renter or any other individual to use the Equipment.

Sole Responsibility for Personal Safety

The Renter acknowledges and agrees that the sole risk and responsibility for personal safety in the use of Stack N Go Totes Equipment rests entirely with the Renter. Stack N Go Totes shall not be liable for any personal injury, death, loss, damage, or expense of any kind arising from or related to the use of Stack N Go Totes Equipment by the Renter or any other individual during the Rental Period.

No Limitation on Scope

This disclaimer applies to all uses of Stack N Go Totes Equipment regardless of the circumstances under which the Equipment is used, the location at which the Equipment is used, and whether or not the Equipment is being used in the manner intended or recommended by Stack N Go Totes.

To the fullest extent permitted by law, we:

Exclusion of Representations and Warranties

To the fullest extent permitted by applicable Alberta and Canadian law, Stack N Go Totes expressly excludes all representations and warranties of any kind, whether express, implied, statutory, or otherwise, relating to the Stack N Go Totes website, services, Equipment, and any content contained therein, or which is or may be provided by any affiliates, partners, or any other third party, except for such warranties as are explicitly set out in these Terms of Service.

Exclusion of Liability

To the fullest extent permitted by applicable Alberta and Canadian law, Stack N Go Totes expressly excludes all liability for any and all damages of any nature arising out of or in connection with the Renter’s purchase and/or use of Stack N Go Totes services and/or Equipment, including but not limited to personal injury, death, and property damage of any kind.

Limitation on Types of Damages

In no event shall Stack N Go Totes be liable to the Renter or to the Renter’s heirs, executors, administrators, or other legal representatives for any special, indirect, incidental, consequential, or punitive damages of any nature arising out of or in connection with Stack N Go Totes services and/or Equipment, whether such liability arises from contract, warranty, tort including negligence, strict liability, or any other legal theory, and whether or not Stack N Go Totes has been advised of the possibility of such loss or damage.

Release and Discharge

By accepting these Terms of Service the Renter hereby expressly and irrevocably RELEASES and FOREVER DISCHARGES Stack N Go Totes, its owner, employees, representatives, contractors, agents, and any other individuals or entities for whom Stack N Go Totes is legally responsible, from any and all claims, losses, damages, liabilities, and expenses of any form whatsoever, including but not limited to litigation expenses, legal fees, damage awards, and costs of any kind arising out of or related to:

(a) the Renter’s violation of any provision of these Terms of Service; and

(b) the Renter’s purchase of and/or use of Stack N Go Totes services and/or Equipment.

This release and discharge shall apply to the fullest extent permitted by applicable law in the jurisdiction in which the claim arises.

Indemnification

By purchasing and/or using Stack N Go Totes services and/or Equipment the Renter agrees to fully INDEMNIFY Stack N Go Totes and to save and hold Stack N Go Totes, its owner, employees, representatives, contractors, agents, and any other individuals or entities for whom Stack N Go Totes is legally responsible, completely harmless from any and all claims, losses, damages, liabilities, and expenses of any form whatsoever, including but not limited to litigation expenses, legal fees, damage awards, and costs of any kind arising out of or related to:

(a) the Renter’s violation of any provision of these Terms of Service; and

(b) the Renter’s purchase of and/or use of Stack N Go Totes services and/or Equipment.

Governing Jurisdiction

The foregoing exclusions, limitations, release, discharge, and indemnification shall apply to the fullest extent permitted by applicable law in the Province of Alberta and the laws of Canada applicable therein.

Rules & Warnings

RULES AND WARNINGS

Due to the inherent risk of personal injury associated with the use of moving Equipment, the following rules and warnings shall apply to all uses of Stack N Go Totes Equipment by the Renter and any other individual using the Equipment during the Rental Period. The Renter is solely responsible for ensuring that all individuals using the Equipment are aware of and comply with the following rules and warnings at all times.

Stacking Limit

Totes shall not be stacked more than four (4) Totes high when packed and loaded. Stacking packed Totes beyond this limit creates a serious risk of collapse and personal injury. The Renter assumes full and sole responsibility for any injury, loss, or damage resulting from failure to comply with this stacking limit.

Weight Capacity

Totes shall not be filled beyond the maximum weight capacity of sixty six (66) pounds per Tote. Exceeding the maximum weight capacity creates a serious risk of personal injury and Equipment damage. The Renter assumes full and sole responsibility for any injury, loss, or damage resulting from overfilling of Totes beyond the stated weight capacity.

Wire and Rod Warning

Stack N Go Totes Equipment contains internal wire rods located in the lid area of each Tote. These wire rods are fitted with protective plastic end caps. However in the event that a plastic end cap becomes dislodged or breaks off during use the underlying wire rod will be exposed. Exposed wire rods are sharp and may catch on clothing, cause cuts, or scrape skin. The Renter is strongly cautioned to inspect all Tote lid areas prior to use and to exercise caution around the lid area of all Totes at all times during the Rental Period. Stack N Go Totes shall not be liable for any injury, loss, or damage resulting from contact with wire rods or exposed wire ends during the Rental Period.

Children

Children shall not be permitted to use, operate, climb on, or play in or around Stack N Go Totes Equipment at any time during the Rental Period. The Renter assumes full and sole responsibility for ensuring that children are kept away from the Equipment at all times.

Animals

Animals shall not be placed in, on, or around Stack N Go Totes Equipment at any time during the Rental Period. The Renter assumes full and sole responsibility for any injury, loss, or damage resulting from failure to comply with this rule.

Lawful Use Only

Stack N Go Totes services and Equipment shall not be used for any purpose that is unlawful, prohibited by these Terms of Service, or contrary to any applicable Alberta or Canadian law or regulation. The Renter assumes full and sole responsibility for ensuring that all use of Stack N Go Totes Equipment complies with all applicable laws and regulations at all times during the Rental Period.

Safe Lifting, Carrying, and Stacking

The Renter shall be exclusively and solely responsible for determining the appropriateness and ensuring the safety of how the Equipment is lifted, carried, and stacked and by whom. Stack N Go Totes makes no representation regarding the safe lifting, carrying, or stacking methods to be used by the Renter or any other individual using the Equipment during the Rental Period. The Renter assumes full and sole responsibility for all injuries, losses, or damages arising from the lifting, carrying, or stacking of Equipment during the Rental Period.

Termination of Service

Stack N Go Totes reserves the right to terminate the Renter’s access to and/or use of Stack N Go Totes services and/or Equipment at any time and at its sole and absolute discretion without prior notice to the Renter.

Default and Breach

In the event that the Renter defaults on any obligation or breaches any term of this Agreement, all amounts owing to Stack N Go Totes by the Renter, including but not limited to rental fees, replacement fees, cleaning fees, late fees, delivery fees, collection costs, and legal fees, shall become immediately due and payable in full by the Renter to Stack N Go Totes without further notice or demand.

Recovery of Equipment

In the event of default or breach of this Agreement by the Renter, Stack N Go Totes reserves the right to take all steps legally available to it under applicable Alberta and Canadian law to recover its Equipment from the Renter. The Renter agrees to cooperate fully with Stack N Go Totes in facilitating the prompt return of all Equipment upon termination of this Agreement or upon demand by Stack N Go Totes following a default or breach.

Where the Renter consents to entry, Stack N Go Totes or its authorized representatives may enter the premises where the Equipment is located for the sole purpose of recovering the Equipment. Where consent to entry is not provided by the Renter, Stack N Go Totes reserves the right to pursue all available legal remedies to recover its Equipment including but not limited to seeking a court order authorizing recovery of the Equipment.

Recovery Costs

All costs and expenses incurred by Stack N Go Totes in recovering its Equipment from the Renter following a default or breach of this Agreement, including but not limited to transportation costs, legal fees, court costs, and collection agency fees, shall be the sole responsibility of the Renter and shall be immediately due and payable upon demand by Stack N Go Totes.

Force Majeure

Stack N Go Totes shall not be liable to the Renter for any failure to perform, delay in performance, or partial performance of any obligation under this Agreement where such failure, delay, or partial performance is caused directly or indirectly by an event or circumstance beyond the reasonable control of Stack N Go Totes.

Events Constituting Force Majeure

For the purposes of this Agreement a Force Majeure event includes but is not limited to any of the following circumstances:

Acts of God including but not limited to earthquakes, floods, storms, lightning, hurricanes, tornadoes, blizzards, and other extreme weather events. Epidemics, pandemics, or public health emergencies declared by any competent governmental authority. Acts of terrorism, war, political insurgence, insurrection, riot, civil unrest, or uprising of any kind. Acts of civil or military authority, government orders, sanctions, embargoes, or regulatory actions that prevent or restrict the performance of obligations under this Agreement. Infrastructure failures including but not limited to power outages, internet outages, and telecommunications failures. Any other natural or man made event or circumstance beyond the reasonable control of Stack N Go Totes that causes the termination of or prevents the performance of any obligation under this Agreement and which could not have been reasonably foreseen or prevented by Stack N Go Totes.

Effect of Force Majeure

In the event of a Force Majeure occurrence Stack N Go Totes will make all reasonable efforts to notify the Renter as soon as practically possible and will work with the Renter to reschedule or make alternative arrangements where reasonably possible. Stack N Go Totes shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages of any nature arising from or related to any failure, delay, or partial performance of obligations resulting from a Force Majeure event.

No Waiver of Renter Obligations

A Force Majeure event does not release the Renter from any of the Renter’s obligations under this Agreement including but not limited to the obligation to return all Equipment to Stack N Go Totes in accordance with the terms of this Agreement. The Renter remains fully responsible for all Equipment in their possession during a Force Majeure event and shall take all reasonable steps to protect the Equipment from damage, loss, or theft during such an event.

General

By purchasing and/or using Stack N Go Totes services and/or Equipment the Renter represents and warrants that they are at least the age of majority in the Province of Alberta or their province or territory of residence.

Governing Law and Jurisdiction

These Terms of Service and all matters arising out of or relating to these Terms of Service shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein. By purchasing and/or using Stack N Go Totes services and/or Equipment the Renter hereby consents to the exclusive jurisdiction of the courts of the Province of Alberta in all disputes arising out of or related to these Terms of Service or the use of Stack N Go Totes services and/or Equipment.

Severability

If any provision of these Terms of Service is deemed invalid, illegal, or unenforceable for any reason whatsoever including but not limited to the exclusions and limitations set out herein then that invalid, illegal, or unenforceable provision shall be severed from these Terms of Service. The remaining provisions of these Terms of Service shall continue in full force and effect and shall not be affected by the severance of any invalid or unenforceable provision.

No Waiver

The failure of Stack N Go Totes to enforce any provision of these Terms of Service at any time shall not be construed as a waiver of that provision or of the right of Stack N Go Totes to enforce that provision at any future time. No waiver of any provision of these Terms of Service shall be effective unless made in writing and signed by Stack N Go Totes.

Amendments

These Terms of Service shall not be amended, modified, varied, or supplemented except in writing signed by an authorized representative of Stack N Go Totes. Stack N Go Totes reserves the right to update or modify these Terms of Service at any time at its sole discretion. Any such updates or modifications will be posted on the Stack N Go Totes website and will be effective immediately upon posting.

Notification of Changes

These Terms of Service were last amended on June 30, 2026. Stack N Go Totes reserves the right to amend, update, or modify these Terms of Service at any time and at its sole discretion without prior notice to the Renter. The Renter’s continued purchase and/or use of Stack N Go Totes services and/or Equipment following any such amendment, update, or modification shall constitute the Renter’s acceptance of the revised Terms of Service in their entirety.

The Renter is strongly advised to review these Terms of Service on a regular basis to ensure they are aware of any amendments, updates, or modifications that may have been made since their last visit to the Stack N Go Totes website.

Deemed Acceptance of Full Terms of Service

By purchasing and/or using Stack N Go Totes services and/or Equipment the Renter is deemed to have read, understood, and agreed to the full Terms of Service contained herein in their entirety without exception.

WordPress Terms of Service

As the Stack N Go Totes website is hosted through WordPress by Automattic Inc., by accessing and using the Stack N Go Totes website the Renter is deemed to have read, understood, and agreed to the WordPress and Automattic Terms of Service located at https://wordpress.com/tos and all other terms, policies, guidelines, agreements, and addendums referenced therein.

Stripe Terms of Service

As Stack N Go Totes uses Stripe as its third party payment processor, by purchasing Stack N Go Totes services and/or Equipment the Renter is deemed to have read, understood, and agreed to the Stripe Terms of Service located at https://stripe.com/en-ca/legal/checkout and all other terms, policies, guidelines, agreements, and addendums referenced therein.
